1. Acceptance
By creating an account or using PaperGrade, you agree to these Terms and to the Privacy Policy. If you are using PaperGrade on behalf of a school or district, you represent that you have authority to bind that entity to these Terms.
2. Who may use PaperGrade
PaperGrade is for K–12 educators and school districts. Students do not create accounts. You must be at least 18 years old to hold a PaperGrade account.
3. Beta notice
Portions of the Service are in beta. Beta features are provided as-is, may change or be removed, and should not be relied on for high-stakes grading without teacher verification. Teachers remain responsible for final grades.
4. Account security
You are responsible for the confidentiality of your credentials and for activity under your account. Notify us immediately of any unauthorized use.
5. Acceptable use
You will not:
- Upload content you do not have the right to upload, including student work from schools where you are not an authorized educator.
- Upload data from students outside the United States.
- Attempt to reverse-engineer, scrape, or overwhelm the Service.
- Use PaperGrade for purposes other than the educational grading and standards-tracking for which it is offered.
- Circumvent access controls or attempt to access another teacher’s or district’s data.
6. Student-data responsibilities
You confirm that you have authority under your school’s or district’s policies and applicable law to upload student information into PaperGrade. You will honor parent and student rights under FERPA, COPPA, and applicable state law. PaperGrade processes student data solely on your instructions, as described in the Privacy Policy.
7. Grading accuracy
PaperGrade uses AI to assist grading. AI output may be incorrect. Teachers are solely responsible for reviewing and finalizing grades. PaperGrade is not a system of record for official student grades unless your district has independently approved it for that purpose.
8. Payments
- Subscriptions are billed through Stripe. By subscribing, you authorize recurring charges until you cancel.
- Fees are non-refundable except where required by law or expressly stated in writing.
- We may change pricing on 30 days’ notice to active subscribers.
9. Intellectual property
We own the Service, including software, design, and branding. You own the content you upload. You grant PaperGrade a limited license to process your content only to provide the Service.
10. Disclaimers
The Service is provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, PaperGrade’s total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim. PaperGrade will not be liable for indirect, incidental, consequential, special, or punitive damages.
12. Indemnification
You agree to indemnify and hold PaperGrade harmless from claims arising out of your violation of these Terms or your unauthorized upload of student data.
13. Termination
You may cancel your account at any time. We may suspend or terminate access for violation of these Terms or applicable law. On termination, data retention follows the schedule in the Privacy Policy.
14. Governing law and venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws rules. Exclusive venue for disputes is the state and federal courts located in Jackson County, Missouri, and you consent to personal jurisdiction there.
15. Changes
We may update these Terms on 30 days’ notice to account holders. Continued use after the effective date is acceptance.
